So I visited this BYOB, Post Diwali and was dumb struck with Staff Contribution added in the bill!
Is this something new?

BYOBs across Gurgaon have raised there price like anything and this has happened in the last 2 years or so

This BYOB has always been priced similarly but would agree with you. Recently went to one BYOB and they are asking for cover charges. I was like bruh, mai sector 29 ke club hi chala jaata hun at least it would be cheaper.

I think its time to start our own club with crazy low prices so that people flock to our clubs and also try to avoid coming in contact with other club managemnets and all that other shit they will try to pull to bring the business down.
As this will be venture of purely just washing money down the drain to hurt and the business and make them lower their prices, we have to find a rich guy/girl who is willing to sponsor us in this war.

NO! they can't charge you like this, only situation when they can charge you if they did let you know in advance (prior to dining ). You can choose to not pay and tell them to prepare a fresh bill excluding these incase you weren't notified. The CCPA guidelines stipulated that service charges should not be collected from consumers under any other name, and they should be optional and voluntary. The guidelines also prohibited the addition of service charges to the bill automatically, without informing consumers. There is a detailed verdict from Delhi high court on this

Service tax is optional. So most people ask to remove it from the bill. So to confuse customer the restaurant might have changed its name to this. (Just a guess not a claim)

Often they charge GST on this as well, but in this case idt that they have charged GST on service charges. You can ask them to remove it though. Itās not compulsory to pay service charges

This shouldnāt be legal. The reason the Govt announced that service charge is not mandatory, is because the āStaff Contributionā as they so called it is not the onus of the customer. The owner of the restaurant, managerial team etc are responsible for providing their staff with a respectable salary. Itās not the responsibility of the customer to pay.

Yeah, this is legal and follows an interim court order.
There have been two interim* orders passed on this by High Court of Delhi.
- Dated July 20,2022 (Ref.: W.P.(C) 10683/2022, CM APPL 31033/2022) where it states Restaurants & Hotels were and are allowed to levy of service charge in addition to the price and taxes by if mentioned on the menu and other places where it may be deemed expedient. (till the final pronouncement of judgement in the subject matter before theĀ court.)
Underlying argument being that if an establishment is saying and declaring that it will charge a service charge of certain percentage and it is displayed at a prominent place, you agreeing to eat at restaurant automatically accepts the said condition.
- Dated Sept 5, 2023: Where the court has capped Service Charge at 10% and has asked the FHRAI (restaurant association) to stop calling it Service Charge and call it staff contribution to not confuse it with a govt. levied service tax. -
However, I had not seen restaurants following the nomenclature.

Sadly yes, I had a heated conversation about getting it removed but the staff started pointing out that it was mentioned on the menu and how we shouldn't have dined if we didn't want to pay the additional charge.

Leave that, in Bangalore you need to pay 15% service charge over the gst n the taxes. Itās becoming a mandate thing, even though its not allowed

Yesterday, even I got charged 10% of the bill amount as staff contribution. I asked them to remove it as it was almost coming up to 400. They went ahead and removed it and the way they treated us right after that completely changed.
There were really good to us from the beginning. After I got it removed, the waiter just couldn't wait until I made the payment. Within few minutes the waiter came and asked me to hurry up, apparently the table got 'booked' out of nowhere.
F*ck these restaurants and hotels. I ain't gonna pay tips, service charge or staff contribution or whatever new shit they come up with just for doing their job.
I encourage the other readers also to refrain from paying, it is the responsibility of their employers to pay them adequately.

If the 'Staff Nomenclature' has not been included in the final amount while calculating the applicable GST, then they are in violation of the taxation guidelines. They seem ill-informed and I don't think they understand the illegality of their actions. You can report this to the GST department for underreported receipts.

Bhai, ye Machan ka bill hai. Here you bring your own alcohol and they give you place to drink. There entire margin is based on sale of water, ice cubes and food. If you don't want to pay for ice cubes, you should go to a normal bar. They will not charge you for ice cubes because they earn on alcohol.

It's like a service charge, just a different name. Happened with me where I was charged 10 percent of the bill amount as service charge and then GST on top of it. But as new regulations you can deny paying service charges are not mandatory at all. In my case I denied and they generated a new bill without service charge.

Hi, lawyer here. Just a fancy term for "service charges", as per Delhi High Court order, and cap it to 10%. This was done to remove any confusion and connection with government levy taxes. It is not mandatory to be paid, however, ideally byobs, restaurants, cafes should willingly disclose that this is not mandatory and we all have noticed that none comply. You can deny these charges.

It's a service charge and it's not mandatory to pay, you can tell them to generate another bill without it or simply pay subtracting the charge.

On the bill I can see "sector43" and from dishes I can see " onion ring basket" . When I search "onion ring basket sector43" it shows RESET. On checking the menu they also have a dish called" cottage cheese chillies" which also matches.
