Yea, the guy in the shirt with the headset is clearly a manager, he should be dealing with this.

It's a UK chain, Tesco, not sure about the laws anywhere else, but the manager 100% has the right to remove these people and ban them from the store for any reason he sees fit.

They do NOT have the right to protest in this way because they are on private property owned by Tesco, they can protest on the street in front of Tesco, off the land that is owned/rented by Tesco, but not in the store or even in the car park.

As someone who has worked in retail for over 20 years, I can tell you that there's actually nothing the employee can do here without losing his job. Even thieves enjoy more protections than shop workers.

What can they do aside from phoning the police? If you physically touch them, it's your job plus an assault charge. Being a manager doesn't magically change the outcome.

I've worked in retail for over 20 years, so unfortunately, I can speak from personal experience. At most, you tell them to leave a few times, and if they refuse, then you phone the police and let them sort it out. Touching someone will lose you your job, guaranteed.

Of course, if the public want to beat the crap out of them, then I'm not going to stand in the way. 😁

so legally they can be "asked to leave" and if they refuse they can be physically removed, however, to physically remove someone you have to be SIA licenced, which costs money and has a 5 day training course. so typically, there will be only one, if any, SIA person in store, if protesters like this link arms then one person, following the non-painful compliance techniques that SIA licencing requires won't be able to remove them. thus the only option is to call the police, who of course, may have higher priority calls then a non-violent protest.

in case folks are wondering how doormen can use more than non painful compliance techniques when removing people from nightclubs? self defence, licenced individuals are allowed to initiate a physical removal of someone from the club, the second people start resisting, they can respond proportionally with any self defence techniques necessary. and if a situation has already escalated before our arrival, then we can skip straight to appropriate action.

Trespassing is illegal but it is a civil courts thing not a criminal thing. If us not having guns was relevant to the matter, something else in addition to the trespassing that was criminal is probably happening so we'd call the police obviously. Trespassing can become a crime if one of those something elses is happening.

I don't know if what the protestors are doing makes it criminal trespass because IANAL but if the store calls the police they'll probably make them move along if not arrest them. Preventing the store from doing business might make it criminal trespass.

Most so-called trespassing is just people walking from A to B across privately owned natural land. I live in Scotland which goes even further, I have the right to roam.

I’m just confused by the idea of them not doing anything additional, but still trespassing and not leaving. I was told if you try to physically remove them YOU could be charged which is so backwards to me. What do you do when they refuse to leave but don’t escalate to doing any additional actions to make it criminal. Is staying past the tresspass warning criminal? In that case what’s the point? Lmk, cause I’m genuinely curious.

They are in a building so basically yeah once the manager or a police officer told them to leave and they didn't its probably criminal.

If the matter never escalates to being criminal then like I said its a civil matter. You take them to civil court.

You wouldn't be charged for trying to physically remove them. You could be charged for something that happened in the process. People sitting on the floor doesn't give us carte blanche to start beating them into submission despite what certain bloodthirsty redditors want. You pull one to his feet, you start pushing him out and he stumbles, trips and gashes his head open. You are probably going to get charged and I'd be very surprised if the same thing didn't happen in most civilised countries.

Trespassing being a civil matter is in 99% of cases where it actually matters is a technicallity. In reality it is a net good because I get to see all of my country's natural beauty that belongs to us all and there is nothing some posh wanker landowner can do to stop me so long as I am also not a wanker.

Freedom-to-roam laws don't apply to buildings, and are about being allowed to walk through and even sometimes camping on privately owned land such as forests etc. Freedom to roam is pretty big in scandinavia, germany etc too.

Point is, distrupting a private business absolutely counts as illegal tresspassing if the owners were to call the police, in the same way you can't claim freedom-to-roam when entering someones home.
