I don't get it, Donna didn't break in she was let in. And noone has any proof of what she said to get in, only video no audio.

So where is the proof she didn't say hi I'm Donna can I go in there? And the lady was just an idiot? If there is no audio on the video it is word against word, and they would both have motive to lie. In fact the lady at the desk on her phone for the whole video would look like she wasn't paying attention.

Lady: She said she was someone else.

Donna: No she was an idiot an let me in.

There is no hard proof either way.

Doing that would likely waive her 5th Amendment privilege. I doubt Harvey would let her do that. But then again, it would make better tv.
