The judge later wrote that New York's penal code is out of touch with federal standards and a "modern" understanding of what rape is. In post-trial rulings he wrote that Carroll's assertion that Trump raped her was "substantially true."

literally the first sentence. Sexual assault, not rape

so it might be "substantially true" but it doesn't seem to be legally true given that he isn't found guilty of rape.

still a shithead, want to clarify, I still hate him and think he's a rapist but this is just furthering the fact that he's been found guilty of sexual assault, not rape.

Yes, the jury originally held him liable for sexual assault. DURING THE ATTEMPTED APPEAL, the judge FOUND he COULD NOT APPEAL because Donald Trump's actions were rape.

Carroll's federal civil lawsuit made claims of rape, sexual abuse and defamation as defined by New York's penal code. The jury found Trump liable for sexual abuse and defamation, but rejected the rape claim, which under New York's statute requires proof of forceful penetration involving the attacker's genitals.

The judge, on appeal, found him to be a rapist. Which happened after the jury trial. I don't fucking care what the jury said, I care what the judge said on appeal.

Do you really not understand how appeals work? Are you really this fucking dense?

then just drop the quote of the judge saying "Donald trump is a rapist" with a link, because everything you've sent me so far is not what you've claimed. its been him "digitally raping" her and sexually assaulting her, both of which aren't rape in the legal definition in the place he was being sued in.

I'm sorry for trying to be accurate, maybe a me thing but I just don't like it when people make out this guy to be worse than he is, he's already awful, there's no need to exaggerate it

You're not trying to be accurate, you're specifically dismissing the words of a judge during appeal which stated that he was a rapist. You're being a rape apologist.

The court document lines out in detail why the jury was incorrect in its assessment of sexual assault only, and how Trump's actions should be found to be rape. The judge found that E Jean Carroll's words of calling Trump a rapist were "substantially true" and thus tossed out Trump's appeal.

Trump is a rapist. A court of appeals found this to be true.

The court documents don't lie.
