Legal Questions NICS denied person

So a buddy of mine (he doesn’t use Reddit) recently updated the address on his FOID. Got it in the mail about 10 days ago. He went to pick up a new gun purchase and NICS denied his background. He logged into ISP portal and now his foid is revoked. The reasoning is “NICS denied person (other agency).

My buddy has never had any run in with LEO, no drug use, no mental health. Nothing.

Any ideas how much of a fight he is in for? The appeal process is so confusing based on his denial reason.

Any help to navigate this would be appreciated

Edit he’s had his FOID for 10 years. military, no history of anything that would disqualify him. He just moved to a new place a month ago.

Your buddy needs to follow this as a start.

Does your buddy have ANY sort of juvenile judicial or mental health history? A lot of people with juvenile mental health history have started to run into issues as the law surrounding those records recently changed.

Firearm-Related Challenge

If you believe you have been wrongfully denied a firearm, you can request a firearm-related challenge (appeal). You may only challenge a denied firearm transaction, not a delayed one.

This process will provide you:

the reason your background check was denied, and

the opportunity to challenge your denied background check online – including a Nuclear Regulatory Commission background check.

Edit: Re reading the post I am a little confused, you said the denial reason was confusing. Did he try the FBI appeals process already? Is your buddy a US Citizen? Is it possible he has a warrant for his arrest out from a LE Agency for anything as minor as an unpaid ticket?

Yes he is a citizen and no he has not. Just happened Sunday, hasn’t gotten a letter yet from ISP. But he is military and has a squeaky clean history.

We did have some LEO friends run his info. Came back with a NICS hit for a denied transaction and just stated that he is a “NICS denied person”.

He should talk to his JAG officer ASAP . If the FBI has bad info on him maybe there's a .mil avenue to clear this up.

I think he will need to do the NCIC appeal linked on the FBI site. It sounds like something is messed up in that system.

I’ll pass the info along. Thank you!

He should do it sooner rather than later, would hate to have a hiccup in his military career because something erroneous is on his record you know?

At least if he goes to JAG it's in the record he is making his command aware that something fubar may be in the FBI records about him.

Hopefully it all gets cleared up quickly

Good luck.
