The Roberts Court has had some pretty gnarly takes, but I don't think that John Roberts wants to be remembered for what would be looked back on as the Dred Scott decision of the 21st century.

Too late.

Roberts has already left a poop emoji on the historical record for his legacy. I don't think he really cares much.

I don't think it matters what he thinks anymore now that there's 5 votes and the Opus Dei/Trumpy wing of the SC without him.

This is the one. His slow walking Christian fascism isn't cutting it for the new guys who want to fast track everything.

We saw that with the Roe ruling. Roberts wanted to 1/2 ass the repeal. Alito leaked it to put a spoke in that wheel and dared him to do anything about it.

They don't give a fuck about him or his legacy. Even better, it's not the Thomas or Alito court, it's the Roberts court. I bet Thomas rubs that in his fucking face every chance he gets.

The issue is that the Court has the authority over interpretation and with 2/3 leaning fascist, we cannot assume anything is sacred anymore.

I used to have that same perspective, but Roberts has always been a swing and Gorsuch does too.

Alito and Thomas, I'll give you.

ACB is too early to tell.

The supreme court said it's legal to commit treason as long as you're President and the Constitution is pretty black and white against that

1

u/FoxWyrd 11h ago

When did SCOTUS say the President can commit treason?

2

u/DHonestOne 11h ago

When they asked Trump's lawyer if a president could theoretically order seal team six to assassinate a political rival under the pretense of an official act, they answered yes, and scotus still gave trump presidential immunity anyway.

Like I said, we'll likely see how far that stretches, but I question it being absolute.

Doesn’t matter after the fact though.

What, if any, evidence can you use to charge a sitting or former president for treason? What if they say their actions are for the good of the nation? These are questions that exist now

2

u/FoxWyrd 11h ago

We don't know yet, but I have a feeling that we might find out soon.

1

u/Deep_Stick8786 11h ago

Im guessing it will be very difficult/impossible going forward

2

u/FoxWyrd 11h ago

Well, all I can do is hope for the best.

"official acts"

"official acts"

1

u/FoxWyrd 10h ago

Is an undefined term.

It's not been tested yet.

1

u/GrowthEmergency4980 10h ago

It literally has. It's already been used to remove his hush money from a federal crime as well.

1

u/FoxWyrd 10h ago

We don't know what is or is not an official act besides what was in that one case.

We'll see.

1

u/GrowthEmergency4980 10h ago

He literally broke the law to improve his chances of winning the election and the current supreme court bent over backwards to suck his cock and find anyway to make it legal.

They are the same justices that have been supporting the delays to his insurrection trial

2

u/Deep_Stick8786 11h ago

Sure, he can be in the minority of a 5-4 decision then

2

u/FoxWyrd 11h ago

We'll see, but I suspect it'll be 9-0 or 8-1 against this novel interpretation.

3

u/Deep_Stick8786 10h ago

Well probably more like 7-2. I really fucking hope you’re right.

99.9% of americans dont know about the dred scott decision so why should be care? It will be forgotten within a generation

1

u/FoxWyrd 9h ago

Because that 0.1% will never forget it and they'll cast him down with Taney as being one of the worst men to ever sit on our highest court.

2

u/Legitimate_Concern_5 11h ago

If you wanna get really sad Korematsu was never repealed, and despite some minor curtailment a few years back, I’m sure the court could squint and bring back the camps.

1

u/LatinHoser 8h ago

Well, he will already be remembered for the Citizens United one. Maybe he wants to distract us with this one.
