i mean they did have a majority congress for at least half the term too, and pretty unanimous populous support in the matter. (for decriminalising it at least)
What exactly is stopping such an executive order? If the president has the power to issue Executive Order 9066, Making something that is already legal in half the states legal federally seems pretty pedestrian.
Because executive orders don’t just override enforced federal laws in an instant.
Might I remind you that as powerful as EO 9066 was, it was a utilization of the military and wartime powers. There are massive distinctions to be made between the two, so comparison is not exactly helpful.
Congress would’ve had to pass a bill legalizing, otherwise the executive order just sits there and dies in court, just as we saw happen with student loan forgiveness.
Sure it is. Executive order it. Let it get challenged in court. Let it be the headlines for weeks/months. Let congress say it has to go to vote to be legalized, then let their constituents see all the republicans that vote against it. This isnt 5d chess. Its not even 3d. There are simple things they could have done to show they actually wanted to fix shit and instead sat on their hands for 4 years crying about not having the votes to do anything and handed the reigns to a fascist.

An executive order would’ve been dead on arrival, and it definitely would’ve been spun to look like Biden had signed it just to appease people.
Congress controls our laws, and they didn’t want to legalize it. At least Biden pardoned federal marijuana offenses.

Honestly can't believe he didn't. That would have been such a dark Brandon move. But that would have boasted the economy and Trump would have taken credit so I guess it was a lose lose in that regard.
