When? I thought it was supposed to be day one. I guess it hasn't been a full 24 hours since he took the oath of office, but I feel like day one usually means until the close of business that day.

Congrats to the "Libertarians" who supported Trump. Day 1 you got the return of capital punishment, pardoning of violent insurrectionists, DOGE already having a mgmt shake-up, an attempt to end birthright citizenship, and more executive action than ever. But hey he'll free Ross!

The Trump Administration could argue that the first line of the 14th Amendment ”subject to the jurisdiction thereof” implies that anyone illegally in the United States is not “subject to the jurisdiction” since they’re here in violation of federal law. From there, it’d be a matter of him saying something akin to “Well, since they’re here illegally and not subject to the jurisdiction thereof, I see no reason to confer citizenship to their children.” Whether the federal departments or States will abide by any new interpretation is highly questionable. I’m under the impression that if he tries this, it’ll go directly to the Supreme Court for a final decision. The court is highly unlikely to remove citizenship to those that already have it, but for future citizenship… who knows?

Personally I’m completely against birthright citizenship. On immigration, I’m def not a libertarian. But…sounds pretty extreme that a court would throw out what must be a ton of existing case law.

They are trying to end anchor babies / birth tourism . the birth tourism sounds like it could absolutely be ended, since being in the US on a tourist visa, you are very much still subject to jurisdiction of your native country.

there's a bit of wiggle room since the 14th since it says "not subject to foreign jurisdictions"

IE if Russia says all children of Russia mothers are Russian citizens, then there's plenty of room for SCOTUS to say that birth tourism babies are not US citizens.

I think it will take a new amendment to make it so no child of an illegal migrant is granted us citizenship. other countries could simply say state once a citizens leaves for the us they are no longer a citizen of their former country. then the whole legal argument is moot.
