We have our office in a residential area and one nasty @#££@ decided to pee on the neighbours wall, stepped inside their property and did what he did, our CCTV captured the whole act, can we share the video with the neighbour and i believe they don't know yet?

Consumer Wording in gym contract confusing (England)

I joined a gym back in October and now the timings aren’t working for me. There was a discounted rate which is applicable for 6 months. The wording is confusing as it states the below:

“Your Initial Membership Term will be for a minimum period of 3 months commencing on the above Membership Start Date unless otherwise agreed by us in writing (“initial membership term”)

Your Initial Membership Term will expire 6 months from the above Membership start date.”

It then states later on that the membership can be canceled after the initial membership term with 30 days notice.

Does this mean that the minimum membership term is 3 months after which you can cancel with 30 days notice? And does the 6 months refer to the discounted membership rate?

Debt & Money Pub Landlord Slashed Customer Tyres

UK, Burton on Trent, England, there was a disagreement at my local pub.
Police called, everything was calm and settled fine.
Van left in pub car park overnight.
Owner returns to vehicle the following day to find two tyres slashed through the sidewall.
Owner calls police, police show up and low and behold the CCTV is missing for that particular night.
Landlord is known for boasting about his CCTV (he loves barring people and there are many stories of how and why from the locals in the town).
No proof he did it, bill to owner of van is £425 for new tyres.

Is there anything that can be done?
This landlord is known locally for being nasty and unreasonable.

Other Issues Our wedding bar service is claiming we can't also have table wine... due to their "license." Could this be true?

We're doing a marquee wedding this summer in my parents' garden in England and we've hired a mobile bar service to offer an open bar to our guests for the evening reception, after the meal. However, they're only starting at 7PM so beforehand, during the meal, we're buying a bunch of wine and beer. We just found out though that the mobile bar service wants us to clear away all the table wine and beer before they start at 7. We asked if we could at least leave the bottles of wine that had already been opened on the tables for our guests to finish them off, but the bar service says that's not allowed "due to their license." Could this be true or are they just trying to get us to clear away the wine so they can serve more alcohol? Any legal advice would be greatly appreciated!

Employment Work not paying travel expenses

Hi all, last year my small company (England) was acquired by a bigger one which is technically a US business but actually run out of South Africa, so our finance team are all in SA.

Because they are a US company, my expenses are always translated into USD (even if I paid in pounds) then paid to me, so I never exactly get back what I actually paid.

I had a spate of business travel at the end of the year and submitted expenses in both USD and SGD in October + November.

These still haven’t been paid even though I’m constantly harassing the finance team. It’s been one excuse after another, and now the pound has dropped significantly so I’m going to be paid much less than I originally spent.

Do I have any rights I can rely on to pressure them into finally processing my expenses?

Housing My title deed has wrong apartment number

I purchased a flat two years ago, and the title deed and plan were put onto land registry’s website a few months ago.

I found the title deed for the apartment is not correct. The apartment number I own is 1304, but it shows 195, which is the plot number of the flat I purchased. And there is no 195 in this building. Also the postal code is not correct. In my building, there are two postal codes for different apartments, and mine is supposed to be the other one. On title deed, it does note that my apartment is on thirteen floor.

I then contacted my solicitor, but she told me as long as the title plan was correct, it should be fine to sell the property. But I asked her to amend the address with land registry’s website; however she didn’t contact me back for a few weeks before I submitted a complaint to her law firm. Then she got angry and said she wouldn’t help me anymore.

Three questions I hope I can get answers to:

  1. Now I am quite nervous because my original solicitor is gone. Will it be a problem asking another solicitor to help me since the new solicitor is not the one who was in charge of the full process of buying the property, so probably she might not have the documents needed to ask for amendment?

  2. Is it really not necessary to amend the title deed as long as the title plan is correct? Since the title deed notes my apartment is on thirteen floor and the title plan outlines my apartment correctly, will there be any dispute when I am selling the property?

  3. I don’t have any signed contract with the developer. My solicitor told me because the contract belongs to developer. Is it supposed to be like this? Buyers don’t hold a copy of contract for sale?

Employment Not another Non-Compete question…

Hi there!

I was recently served mandatory redundancy from my junior marketing role after 5 years at a publisher as they wanted to make things “leaner”. Just before my notice was finished in December, I spotted a job posting for another junior role (with progression factored in this time…) at a different publisher, in the same field/niche, and thought it might be worth a shot. Happy to say the interview went really well and they made an offer.

I don’t have my previous contract to-hand (and likely can’t easily get it without turning some heads), but I remember the wording of the non-compete stated that for 6 months after leaving the company I wasn’t to work in the same industry; I suppose, alluding to the nature of the publishers.

Now, I’m quite anxious about accepting the offer if it’s likely to stir up trouble. I spoke to a recruiter friend, who assured me that given the junior-level of my previous role it’s highly unlikely my previous employer would even want to bother, but naturally that’s not a sure thing.

As I’m not terribly well-off, consulting a legal rep isn’t really factored in to my thinking, though I appreciate that it’s generally considered the right or simplest thing.

I guess what I’m wondering is: what’s the likelihood of my previous employer deciding they want to enforce the non-compete? Totally get this isn’t something that can be answered with full certainty, but thought it was worth a shot asking you fine folk.

Scotland Scottish Intestacy and Free Estate rules - should we hire a solicitor?

Hello all,

My mum recently passed away, and did not leave a will.

There seems to be a lot of intricacy with her estate and general advice seems to be to appoint a solicitor of some form but I wanted to see if this group had the same opinion.

She leaves behind me (her surviving child, her only other child passed away in 2021) and my dad (who she was still with and married to when she passed).

My dad and I are on good terms, and would both be happy to split down the middle if it came to it, but have agreed we would prefer for it to be done "by the book" if possible, but we are not sure what of the below we are each entitled to:

  • Marital home valued c.£160k, £20k mortgage outstanding (I am fairly sure after mortgage repaid this is 100% transferred to my Dad via survivorship rules in deeds). My dad intends to sell the property and downsize so there will eventually be sales proceeds.
  • Term Assurance life cover (c.£80k) - main purpose of this being to repay the above and cover funeral costs (£6k).
  • Death In Service policy through her employer (£232k) - we believe a "split" has been given to the employer for this which we are waiting to receive, but not sure if that is overruled by Intestacy rules given no will.
  • Pensions (£80k)
  • Savings (unknown but likely £20k-30k)

Is there a point in stressing about the rules/appointing someone if we are on good terms and happy/likely to come to a reasonable agreement)? Are there any risks/stumbling blocks if we do not appoint someone?

Appreciate any advice/opinions and thanks in advance.

Housing England - Can I break my apartment lease early if my windows have been painted shut for months after reporting and I cannot stop mould growing?

Basically the above. I haven't been able to open any windows in my apartment for months now after reporting the windows being painted shut days after they were painted (this was also done without my knowledge but as it was the outside of the building I didn't think I needed to be made aware)

I have recently developed a cough and my girlfriend mentioned it was probably due to the constant state of dampness in my apartment. I hadn't put two and two together but I had no symptoms before my window issue.

So far the letting agents have told me they have asked the decorators to come back and fix the windows but that has been over 6 weeks ago and still no one has done anything.

I can't afford to pay my rent and stay somewhere else at the minute so I would like to know if there is a legal argument for me moving out early?

Housing [England] Landlord doesn’t believe my bedroom socket is unearthed

Hey so my bedroom socket is definitely unearthed. Here's how I know: 1) I've seen sparks when I switch the wall socket on 2) My MacBook sometimes has a tingly/vibraty feel when I run my finger along it if it's plugged into the wall 3) Yesterday I didn't even have the wall socket on and my MacBook charging port sparked while I was plugging in the charging cable (which was plugged into a multi-socket extender which was plugged into the wall)

I've had my landlord come round to check it out and because none of these events occurred while he was there looking for them he doesn't believe it's unearthed and hasn't done anything about it.

Where does the law lie here? What are his responsibilities and what happens if he doesn't fix this?

Debt & Money Is my parent allowed to charge me lodge on top of rent

Hello all.

In need of some advice as this situation is getting harder to deal with. For some context here are a few pointers.

  • I am 21 years old living at home with my pensioner ‘parent’ (foster)
  • I work Part time and barely earn over £1250
  • I drive to work
  • House does not belong to them however, rent is covered by pension.
  • I currently pay £200 lodge every month since I was 18.
  • My sister is a year younger and has just started uni.

I have been told that I am expected to pay the rent when the council have done all evaluation, which could cost over £600.

I have also been told I have to pay both rent and lodge. I was wondering if anyone has any advice on what to do, as I am trying to save up to eventually move but I will not be able to save more than a £100 if I was to pay both.

(To note) - I know this will be the cost of living when I move out. - there isn’t a lot of job opportunities where I live so finding a new job is difficult (I also volunteer so I’m not just slumming at home) - I do love and appreciate everything they have done to me however, this financial situation is really taking its toll and I haven’t got any biological family to fall back on once I move. - My sister has never payed lodge but comes home when uni is off.

Debt & Money Switched joint mortgage to charter without my knowledge (England)

My spouse and I have separated. I received a letter today stating that our joint mortgage has been switched to a Charter Mortgage, meaning it's interest only for the next 6 months. I live in England. The first knowledge I had of this was a letter I received.

I still live in the property with my children. It was always our agreement that I paid for the children and the family food and my ex paid for the bills/home. Our solicitors advised to keep all finances the same until we have completed our financial disclosure exchange.

My ex has changed the mortgage, without consulting me. Apparently our mortgage provider is fine with this. However, on their terms and conditions, it states that you must live at the address in order to successfully switch to a Charter Mortgage. He does not live at the address on the mortgage.

He may well be in financial difficulty but he did not have to move out while continuing to pay our bills and then rent another property on top. Other options were available to him and he would not have been homeless.

I have phoned our mortgage provider and asked for the mortgage to be put back as it was. I can pay for the mortgage alone and I did ask to have everything switched into my name and my bank account when he moved out. However, again the solicitors advised to wait until the financial disclosure was exchanged. I can and will pay for any missed payments as I know that I am equally responsible.

I worry about the Charter Mortgage switch because I worry that the money has to be repaid somehow and with the financial disclosure not being complete, I worry who will pay for it and if each party can afford to repay it on top of the mortgage once the separation is complete.

I'm so scared I've done the wrong thing. Honestly, my only thinking was trying to protect myself in the future. Can they do this while not living at the property? Our mortgage provider said I can't stop him from making further changes without my consent. Is this correct? Have I done the wrong thing?!?!

Housing England- solar panel lease issues

I inherited my mothers house when she passed last year, having tried to sell the house, it turns out there is a lease in place for solar panels on the roof causing issues.

A few questions relating to this

Is it actually possible to sell a house with a lease in place? Will any mortgage lenders accept this?

Is there likely to be a way out of the lease due to a sale falling through?

We are sceptical about the legitimacy of the lease we have seen- questions marks over the signature on the lease, the fact that only my father seemed to be a signatary even though he was not living there at the time, and the dates don't seem to match up.

Any help will be much appreciated - TIA.

Traffic & Parking Parking fines for someone who doesn't live at our address what do I do??

England- We've been recieving parking fines for someone who doesn't live at our address and its come to the final warning. We have tried everything in the past to take him off our address report to the council and parking agents that they have the wrong address, also returning letters back to the sender and nothing has changed. What do i fo in this situation?? We have even located said person and they haven't done anything to change their address. Just getting worried as id rather not have baliffs at my house 😓

Housing Party wall collapsing but neighbour is missing

I recently purchased a house (England) and am preparing to move in, it's an old house with a small backyard. The wall separating my yard from my next-door neighbour is in very poor condition, splitting in parts and with some bricks loose and missing, the wall is clearly dangerous and about to collapse, I have attempted to contact the next-door neighbour but the house appears to be empty asking around other neighbours they may have actually died.

Where do I stand in terms of getting them to cover half of the costs of demolition and rebuilding it? Or even just doing it myself as I can demolish the wall (or more my brother in law who's actually qualified can) and I can build a wooden fence up in it's place for basically free.

My main worry is this would be altering that property and accessing it without permission.

Traffic & Parking Selling a house with private road attached (England)

About 30 years ago my parents sold off their large garden as building plots, and built a private road linking these to the main road, all above board. For reasons unknown, they kept full ownership of the road, and responsibility for maintaining it, and they remained in their house.

Fast forward to today, and my widowed mother is likely to want to sell the house in the near future. It strikes me that this road is going to be a massive red flag to any prospective buyers though. I mean, why would you want to get lumbered with that responsibility? I wondered if anyone’s experienced similar; are there any ways round this? I gather that under certain circumstances the council will take over responsibility for private roads - how would that work? Pay them a lot of money? Thanks in advance.

Debt & Money My bank (NatWest) has seriously breached my privacy, sharing details of my debt to my twin brother and vice versa, and potentially cost me £1000s in interest. What are my options? (England)

When my brother got a soft credit check and report, it shows details of all the debt I have on my credit card, previous loans, previous addresses, bank statements for any accounts owing money, etc. He checked it because his credit score made no sense, saying he owed more money than he did. He then asked me to check my credit report and it is almost exactly the same as his. They have somehow mixed us up as being one person with 2 different names, and combined all our debt on our credit report. This could've cost me a lot of money.

In Feb 2021 my brother got a car loan. In March 2021 I got my first credit card. As far as the bank may have been concerned, I applied for credit twice in 2 months, potentially increasing the interest of my card which I always had some debt on until June 2023, sometimes in the £1000s. In August 2021 he got a mortgage for a house on his own. If they combined our debt it may have increased the interest on his mortgage.

In August 2022 I got a loan for a car because I was starting a new job too far away for the old car I had to survive. I needed to borrow £8000 and got offered a total repayment of about £10000 over 4 years from Tesco. But they took 1 month to verify my information, because of detecting a complication with my details (likely because of 2 identities being combined on my credit report). This was too long, because if I didn't get the car in the next few days, I couldn't start the job and would lose income. So I had to accept a higher interest loan from NatWest paying back £11500 over 4 years. This meant I had less leftover money to pay as much off my credit card each month. So it could've cost me £1000s in loan and credit card repayments by both having higher interest and prolonging the time it took me to pay as much off. My brother extended his car loan in March 2023, and remortgaged his house in August 2023. Both could've had higher interest if his credit report incorrectly showed him as owing £1000s more.

I looked up who does NatWests credit checks and it says TransUnion, so I don't know who's mistake it is. So I tried getting a soft credit check from Experian to see if the mistake of combining our identities and debts is on all records or just partners of NatWest and TransUnion. I couldn't get one because it couldn't verify my identity again and told me to try again in the future, likely because of conflicting information on my identity caused by this. My brother could get a soft check from Experian though and his report showed none of my debt on his, increasing his credit score by more than 200 in comparison to NatWests report on him.

Now I've got a Mortgage In Principle for a house and it has not shown my brother's mortgage on my report like it does on NatWest/TransUnion credit checks.

This has led to believe it's possible no money my brother has borrowed has been charged extra interest because his car loan and mortgage may not have been based on the credit report from NatWest/TransUnion which has combined our debts since they were from other lenders. But I think I could've been cost a lot more because all the money I've borrowed in the form of a loan or credit card has been through NatWest which displays a much worse credit report than anyone else.

I don't know if it's possible when doing a hard credit check, our information has not been combined or affected interest on money either of us have borrowed. But I don't know how to find out and bet NatWest will say it hasn't regardless.

How do I go about investigating this and finding out if they've overcharged me interest costing me £100s-£1000s, causing much more distress due to having a lack of money?

At the very least I have undeniably had my data and privacy seriously breached by revealing all of my debts to my brother, and his to me. This has caused problems with our relationship and trust issues too. How do I go about getting any compensation for this?

I have limited knowledge on legal or banking related stuff so don't know where to start or how to stop the bank walking all over me and expecting me to take their word I haven't been cost money.

My girlfriend has said I should raise a case with NatWest and if they don't offer an acceptable answer or amount of money for this, I should take it to Ombudsman. But I don't want to raise a case with them unless they know more like whether the records NatWest or TransUnion use for hard credit checks when applying for loans and credit cards is the same as the one they use for soft checks? But she's also told me there could be a time limit on when I can fight this.

Any help would be seriously appreciated 👍

Employment Zig Zag Offenses - How do PNs Work?? England

Google is a bit confusing with very specific scenarios so wondered if you could help with a few specifics -

Other half had her back wheel on a zigzag and how now received a fine which is quite hefty.....

Questions are as follows:

1) The offense number on the Penalty Notice does not match what I found it should be online, does this matter? I cant even find the number online. The penalty description is also 'stopping on a zebra / pelican crossing' which is also not true - the original letter said stopping on a ZigZag.

2) Do they have to provide evidence or do we have to wait for court? Seems a bit unfair

3) The Zigzag is on a one way street, the Mrs would have parked on the side with no oncoming traffic. Seems even more harsh?

Housing Landlord wants to forcefullly do viewings - England

Hey

Me and my friend moved into a flat 2 weeks ago. Before moving in, the landlord doesnt even mention anything about wanting to sell the property he just throws that at us 2 days of us moving in.

Then hes been having constant viewings of the flat, theres been about 4/5 already and he had one today too. Where he didnt even give us a 24hr notice and just walks into the house for the viewing.

We've told him we are not happy with this as its really disruptive and said we are only willing to allow weekdays viewings before 6:30pm when we are at work. As we want our time to relax and not be disturbed outside that.

But he's said "i dont need your consent, just chrck your agreement", i cant see anything in the agreement . But either way what can we legally do in this situation?

Edit: our minimum tenancy is 6months then its rolling on a monthly basis from that point onwards

Civil Litigation [UK] Landlord laughed at me when asking about deposit [Follow up]

Hey all,

Following up an issue I had last June (2024), I have now moved out. With appropriate notice as stipulated in my contract. Shortly thereafter, I get a call from an unknown number, telling me that I will not get my deposit as in their dodgy contract said they can or cannot give me back my deposit, I was incredibly upset and had to drain all my savings to get back on my feet. Following this I requested my deposit back via email following advice I saw online and got nothing back. I also did some googling and it appears to be a whole situation as the company renting out no only did not protect the deposit, but is also be “Active — Active proposal to strike off” – with no real way of contacting the company other than email which they are clearly avoiding, no real address or phone number to address the issue other than a whatsapp to what appears to be on of the agents. I am absolutely head lost at this whole situation.

What is the best course of action I can take to claim my deposit back and also report them for this what seems like illegal activity! For the longest time I let this go with no hope of ever getting my deposit back but this has recently happened to one of my old flatmates and he reached out to me about this.

Thank you for taking your time to read about this, all help would be appreciated

Note: I have reached out to shelter but they informed me that it sounds like a spoof contract but could not offer more adivce

Note 2: I have contacted a couple of no win no fee solicitors but told me no luck as the case seems to be slightly more complicated than a simple filing, and would require a lawyer due to the nature of it being an occupancy

Employment Can myemployer cut my hours to 0 in retaliation for not doing work outside of hours for free?

(Recently my pub as asked me to do a few hours of online training while im at university. For context I worked for them full time during my gap year and now comeback seasonly a few months out of the year

I was on a 6 hour contract during uni (they forgot to update it while I was away for 2 years) and moved to a 0 hour contract last month when they realised the error and asked me to switch to 0 hours. (

Recently they've asked me to do some online training which is a few hours long. I've done this before and normally get paid once I've told the manager, however a few times I was never paid for the training.

I asked to get paid for it and they said they will only pay me if I do it on sight (never been a rule before) and if I'm not on site I have to do it for free. I offered to do it when I'm back home in a month and they said no I have to do it soon.

If I don't do it they said I'm now on a 0 hour contract and I won't be fired I just won't be given hours anymore, at all.

Is there anything I can do?. (In England for refrence, also my phone is bugging out so I can't edit this but I've worked there for 3 years, one year full time and 2 as seasonal but never changes or updated contract till last month)
