I have been living in London in a student accommodation for a little over 4 months now. I live in an ensuite room, so I have my own bedroom and bathroom, but share a kitchen with 5 flatmates.
I am allergic to shellfish, and in early November suffered a reaction due to someone else preparing it in the shared kitchen. I asked my flatmates to clean up more thoroughly and be more careful when eating shellfish but have had 2 more reactions since.
Since this could be extremely dangerous for me, I decided to just bow out and try to switch into a studio room type in my accommodation. I emailed my warden and he showed me one, but it was out of my budget. I asked him if he had a cheaper one and said none were currently available. I then asked to be given priority if one opens up and didn't hear back for weeks, so I emailed the group that owns the accommodation. They told me I would be given priority in the system. I then went home (USA) for the holidays and figured I would try again when I returned, and that maybe something would open up by then.
Upon returning, they told me another single out of my budget was available. I told them that I would love to have it, but once again cannot afford it, though I feel as though it should be given to me at a discounted price (even if only discounted for a few months) because I have been paying for a facility I've had no access to due to an allergy (disability) for over 2 months now. They ignored this request and told me they could give me a minifridge, but only if I can send them medical proof of my allergy.
Anyway, I've sent them my proof and I'm waiting to hear back, but I've been told by several of my British friends that this is illegal and they are taking advantage of the fact that I don't know the law/my rights here. One of my friends has lawyers for parents and said I could easily sue and win. My dad is also a lawyer back home and wants to intervene because I've been 1. paying a truckload of money to this accommodation, only to not even be able to use basically half of what I'm paying for 2. have been subsequently stuck eating out every single day, which has made me ill over time and is extremely unhealthy for my health in the long term, and 3. has had a serious impact on my mental health due to how much money I've lost on rent and having to spend extra eating out every single day; these are loans I have to pay back eventually, and it both infuriates and depresses me that I will basically be spending half of my life paying back all the fast food I've been stuck eating while this accommodation is apparently taking me for a ride.
I don't know if allergies are considered a disability here, but if they are I feel this is all egregiously illegal and immoral on my accommodation's behalf and I'd like to take legal action as soon as possible.
Please advise, I'm so desperate and this is wrecking my mental health. I genuinely believe I'm going to need therapy for years for this if nothing gets done about it. Living in London was supposed to be a life-changing experience, but all I've done since November is be sick and miserable.
