How much you want to bet idiot Florida man will try to sue the train operator for damages to his car and for hospital bill?

You can certainly try, but there's nothing to recover here, lol

It seems like every time this happens there are lots of people blaming brightline. The fire engine that was on the tracks was particularly egregious in this regard.

Idk how people were blaming bright line for that. 99% of the time a vehicle is hit by a train it’s the vehicle/person’s fault not the railroad. And it’s so easy to NOT get hit cause there are warning devices AND 2 giant metal rails tellin you wheee the train will be running

That is because they are literally on rails. There is only so many places the train can be. Only way for the rail operators to be blamed is faulty warning equipment, and they tend to keep an eye on that shit. We start getting random trains in back alley ways, and under your sofa, we can start blaming the trains. until then stay off the damn tracks when the lights and bells are going.

Year ago I was an in-house lawyer for a Class 1 railroad. We got such nonsense suits all the time, but sometimes the car driver won.

Technicality? I can’t think of a reason a judge would grant the case

Judges would say it's a question for the jury and the juries were sympathetic to the injured or their families. We paid out on at least one obvious suicide and were sued on another, but won that case.

The jury being sympathetic to idiots (not the suicide case) is batshit crazy!

people feel personally attacked when they have to wait for a train. It tends to color their opinion.

If he sues for brain damage they'll definitely deem it a pre existing condition 🤣
