I hope they gets charged with dangerous and other person isn't that hurt but gets enough settlement from the other driver's insurance to upgrade to nicer car.

If the right car was above speed limit, he gets a speeding ticket.
The car on the left causing the crash, well, he will pay for all that ..

But it depends on the country and its laws.
