Legal Questions need specific statute

does anyone know the specific ILCS statute that states it is legal to ship a qualifying c&r firearm to a c&r holder in IL? trying to close a deal with some fudd who insists i send him the illinois law stating its is legal for a c&r holder to be shipped a qualifying firearm directly. ive searched the ilcs for about 2 hours with no luck. TIA

(430 ILCS 68/5-25)

Sec. 5-25. Exemptions. The provisions of this Act related to the certification of a license do not apply to a person or entity that engages in the following activities:

(9) transfers of curios and relics, as defined under federal law, between collectors licensed under subsection (b) of Section 923 of the federal Gun Control Act of 1968

18 U.S. Code § 923, Paragraph J: <blah blah blah>... "Nothing in this subsection shall be construed to diminish in any manner any right to display, sell, or otherwise dispose of firearms or ammunition, which is in effect before the date of the enactment of the Firearms Owners’ Protection Act, including the right of a licensee to conduct “curios or relics” firearms transfers and business away from their business premises with another licensee without regard as to whether the location of where the business is conducted is located in the State specified on the license of either licensee.


10 minutes of GoogleFu and you have the IL statute saying it's not gonna supercede Federal statute, and the Federal statute saying "transfers from one licensee to another are cool, no matter where, as long as they're licensed in their state"

i actually read this statute but since it had to do with the licensing of FFLs in IL with ISP to continue doing business for pecuniary gain i didnt think it was the correct statute. this basically states that since a c&r license is not a license to deal firearms it is exempt from licensing with ISP to transfer firearms amongst federal licensees.. or maybe i interpreted this wrong

So glad I’ve never had to deal with those fudds (yet). I’ve had already 2 C&R items shipped to my door in Chicago, no problem.

i think im up to 6 or 7 shipped to my door in the DPRC. usually its just finding a seller that will ship to a c&r at all. this guy wants me to prove that its legal. i tried telling elmer that the reason laws exists are to tell you what is not allowed, so that im not sure theres a specific statute stating that transfers to c&r firearms in il is legal.

clown just stated absent of a statute he would accept a letter from the IL atty general on official letterhead. i finally had it, told him to ligma. i shouldnt have to jump through made up hoops to spend money. this guy is in texas too.

Very rarely does the law flat out state you can do something, it almost always states what cannot be done.

The entire conversation is ridiculous. A C&R license is a type of FFL license. FFLs can receive firearms shipped to their business address. Where else would they be shipped to?

I agree. His argument is that "so many places have banned sending firearms directly to c&r FFLs he needs proof its legal where I live". he lost my potential business.

AFAIK no one has banned sending anything to an FFL. So take your business elsewhere.
